Chennai, Nov 4: The Madras High Court has ordered notice on a petition seeking to set aside the entire election process in the August 18 by-poll from Ilayankudi assembly segment, including election of DMK candidate S Mathiarasan.
The notice was issued by Justice V Dhanapalan on a petition filed by Makkal Manadu Katchi's K Kalaimani, whose nomination had been rejected by the Returning Officer.
Contending that his nomination paper had been 'incorrectly rejected' without passing any orders giving reasons, he submitted that the 'so called defects of minor discrepancies' in the serial number of the proposers was a 'curable' one, which could have been set right at the stage of presentation of the nomination papers.
The rejection was due to alleged non-compliance of the statutory provisions and Election Commission's instructions, he said.
He sought an order declaring the rejection of his papers as 'improper and illegal' and to consequently set aside the entire election process.
